Rental deposit in Spain: how much it is and when to return it

The deposit is one of the biggest sources of conflict when a tenancy ends. Knowing the rules — and documenting the condition of the home — prevents disputes.

How much deposit can be required?

For a primary-residence rental, the mandatory legal deposit is one month's rent. For other uses (commercial premises, seasonal lets) it is two months. The landlord can agree additional guarantees (an extra deposit or guarantor), but the deposit itself is capped at that.

Where is it lodged?

In most autonomous regions the landlord is required to lodge the deposit with the corresponding regional body. Failing to do so can lead to penalties, so check the rules of your region.

What can be deducted?

It is not legal to withhold the deposit for reasonable wear from ordinary use (for example, a slightly marked wall after years of renting). That is why a photo inventory at move-in and move-out is essential.

Return deadline

Once the keys are handed back and the condition checked, the landlord must return the deposit within the set deadline (usually one month from handover). After that deadline, the outstanding balance can accrue interest.

How to avoid conflict

Document the move-in and move-out condition, keep payment receipts, and communicate any deduction in writing with its invoice. With a clear record of each contract and its deposit, the return stops being an argument and becomes a formality.
